Our HOA, rather than accepting responsibility for their ongoing negligence, has involved your law firm to issue a threatening letter filled with false accusations in an attempt to intimidate me. It is extremely disappointing that a legal firm would participate in such tactics—supporting an HOA that has repeatedly mismanaged responsibilities and ignored legitimate safety, maintenance, and habitability concerns raised by residents. Instead of addressing the documented failures and damages resulting from their neglect, the HOA is now using legal threats as a method of harassment and retaliation against a homeowner seeking lawful resolution and accountability. I recently received a Cease and Desist letter from Dirk Petchul, Esq., a partner at Whitney | Petchul, on behalf of my homeowners' association. The letter was filled with baseless accusations, including the absurd claim that I provided "misleading photo-documentation" of issues within the community. Let me be clear: inanimate objects—such as trees, cars, and property conditions—cannot be misleading in a photograph. This ridiculous notion doesn't hold up to basic logic, let alone legal scrutiny. The myriad of videos I have provided on my Google Drive completely shut down his nonsensical legal jargon. Any judge or jury would see through this flimsy attempt to discredit valid concerns. This lawfirm was hired by my homeowners association. I have tried to get matters resolved but this lawfirm does not return calls. Furthermore they are less than truthfull when asked who is present in the office. I have a plumbing matter that needed to be addressed. The management company refuses to talk to me an insist I go through this law firm. It has been over a week and a Ms. Michael the attorney who wrote me a letter requesting I go through her office and no phone calls. It appears they are just milking my homeowner's associaton for legal work that she is not doing.
