The HOA issued fines not in accordance to FS 720.305(2), Procedural Audit of Their "Decision" To be legally valid, the decision they provided must have come from an Independent Fining Committee—not the Board of Directors. Under FS 720.305(2): •The committee must have at least three members who are not officers, directors, or employees of the HOA, and not related to them. •The committee's only role is to "confirm or reject" the fine. If the committee that made the decision included Board members or their spouses, the entire fine is void. I made a full payment to Becker & Poliakoff on April 28, 2025, to resolve my HOA debt. At the time, they gave me no indication that it was a “partial” payment. Then, on May 8, they sent me a notice claiming I still owed over $2,000 in fees I had never been told about. Trying to resolve the issue, I paid the additional $2,000 on May 14. Today, it’s been 15 days and my HOA account is still frozen because they still haven’t received the money . I’ve called, I’ve emailed, and they haven’t responded at all to explain what’s happening. I’ve been left completely in the dark and unable to access my account. My experience with these clown is they are just a bunch of lying crooks. According to the news paper one of the attorney clowns went to jail for money laundering this year 2016. I guess money laundering is a pretty easy thing for a attorney to do. I tried filing a bar complaint this year against two of the attorneys but that did not go to far. The Florida bar would rather protect attorneys than the public in my opinion. These clown took about $250,000.00 from my association in fees and in my opinion did nothing. Screw Becker and Poliakoff! No one answered the phone. No answering machine. I'll move on to another lawyer if this is how the process is starting off.
